The following House Rules apply to any licensed use of the Premises and are subject to change in Licensor’s sole but reasonable discretion from time to time. Any updates to the House Rules shall be effective upon their communication to the Licensee. Failure to comply with any of these House Rules may subject Licensee to fees to remediate any damage or otherwise rectify such failure. Material failures to adhere to these rules (or other provisions of this Agreement) which result in (or are reasonably likely to result in) loss of life, serious bodily injury, or damage to property may result in the immediate termination of the Licensee’s occupancy.
1. Licensee may not access the Premises any sooner than 4:00 PM EST on the Commencement Date. Licensee shall vacate the property no later than 10:00 AM EST on the Expiration Date.
2. No smoking is permitted on the Premises.
3. No pet may be kept on the Premises without prior written permission from Owner, subject to additional fees and/or deposits as allowed by law.
4. No parties may be held at the Premises. Any guests in excess of (4) over the Licensee are prohibited unless specifically authorized by Licensor before the guests arrive.
5. Refrain from disturbing in any manner the vegetation growing, or the wildlife existing, on the Premises.
6. Quiet hours are from 11:00PM EST to 8:00AM EST. Please be mindful of noise that may be heard by the neighbors at all times but especially during quiet hours.
7. No rearranging the furniture or other Personal Property located in the Premises.
8. Any condiments, dressings, detergents, soaps, and other consumables which exist on the Premises from time to time are available for use at the risk of the party consuming/using such item.
9. No parking is permitted in any portion of the grass/landscaping or public right of way adjacent to the Premises. Licensee and all guests shall park in the driveway.
10. Security cameras fitted to the exterior of the Premises or about the Property (if any) are not for the security of the Licensee. Licensee is responsible for its own safety and security during the License Period.
11. Cleaning of the Property may be provided during the License Period for a fee.
12. Garbage and all trash must be placed in plastic trash bags, tied and put in designated containers. Littering is strictly prohibited. All recyclable materials must be placed in designated containers. Trash pickup day is Wednesday (unless holiday week which is then delayed one day). Recycle pickup is Wednesday of alternating weeks (unless holiday week which is then delayed one day).
13. At the end of the License Period, all Personal Property must be returned to its original orderly location, all trash must be placed in the appropriate bins (outside), all bedding and other used linens should be removed and placed in the laundry area, and all dishes must be placed in the dishwasher (if dishwasher safe) or otherwise cleaned. The dishwasher should be started.
*Sea Turtle Season (Taken Very Seriously)
The Town of Melbourne Beach as well as Brevard County has a Lights out for Sea Turtles
ordinance effective May 1 – October 31 that requires all lights visible from the beach to be either
covered, blocked, moved, or turned off after 9 p.m. This includes flashlights, cellphones, and red
lights. Never approach or touch a nesting sea turtle. Keep lights off, stay back, and be quiet. If
she is disturbed, she may return to the ocean without laying eggs, or may leave before covering
her nest completely. Allow hatchlings to crawl on their own to the ocean. Turtles imprint on the
beach that they hatch on and picking them up could interfere with this natural process. Do not
remove hatchlings or eggs from a nest.
